A Colombia employment contract template is far more than a downloadable form. It is the document that defines the rights, obligations and risks of the employment relationship. Yet many companies download generic templates from the internet and sign them without verifying whether they comply with the Código Sustantivo del Trabajo (CST), recent reforms and current case law. The result can be a poorly documented employment relationship that ends in litigation. What Is a Colombia Employment Contract Template?
From a legal standpoint, an employment contract is the agreement by which an individual undertakes to provide a personal service to another, under continuing subordination and in exchange for remuneration. This is defined by Articles 22 and 23 of the CST. The law does not require a specific form, but it does require three essential elements: personal activity, subordination and salary.
A well-structured Colombia employment contract template must reflect those elements and also adjust to the type of employment relationship being agreed upon. CST Articles 45, 46 and 47 recognize several types: fixed-term contract, contract for a specific work or project, indefinite-term contract, and occasional or accidental work. Each has different rules on duration, renewal, notice periods and severance indemnities.
For example, a fixed-term contract cannot exceed three years, is renewable and requires 30 days' notice if the employer does not wish to renew it. An indefinite contract, on the other hand, has no set end date and operates by default when no term is agreed in writing. A properly drafted Colombian labor law template must clearly distinguish these modalities.
Why an Up-to-Date Template Matters
Colombian labor law has changed significantly in recent years. Law 2101 of 2021 gradually reduced the maximum weekly working hours to 42, fully in effect since July 2026, without salary reduction. Law 2466 of 2025 amended the CST on key points: night work now begins at 7:00 p.m. (previously 9:00 p.m.) and the Sunday and holiday surcharge will progressively rise to 100% as of July 2027.
These changes have a direct impact on any Colombia employment contract template. If your model does not account for the new night shift starting at 7:00 p.m. or still calculates Sunday surcharges at 75%, it creates legal and financial risk. Furthermore, Article 64 of the CST establishes severance indemnities for dismissal without cause, with amounts varying based on the worker's salary (below or above 10 minimum monthly wages). A template that fails to clarify these variables can lead to incorrect severance calculations.

General Process for Implementing an Employment Contract Template
Drafting a Colombia employment contract template is not simply a matter of filling in blanks. It requires a preliminary analysis of the nature of the work, the worker's profile, the place of performance and the applicable salary regime. The template should include, at a minimum: identification of the parties, position and duties, workplace, working hours, salary and payment method, probation period, contract duration, termination causes, confidentiality clause if applicable, and signatures.
The probation period, regulated by Articles 76 to 78 of the CST, cannot exceed two months. In fixed-term contracts of less than one year, the probation period cannot exceed one-fifth of the agreed term, up to two months. A generic template often overlooks this proportional rule.
Another critical point is the comprehensive salary (salario integral) clause. To be valid, the worker must earn at least 10 minimum monthly legal wages plus the benefits factor. Many employment contract templates in Colombia copy this clause without verifying the amount, rendering it ineffective and exposing the employer to claims for full social benefits.

Common Mistakes When Using an Employment Contract Template
- Using an outdated template: Including clauses that do not reflect Law 2101 of 2021 (42-hour workweek) or Law 2466 of 2025 (night surcharge from 7:00 p.m. and progressive Sunday surcharges) leads to non-compliance.
- Relying on an oral contract: CST Article 37 permits oral contracts, but proving their terms in litigation is extremely difficult. Without a written document, a judge will presume the contract is indefinite and the salary is the highest amount claimed by the worker.
- Omitting the notice requirement in fixed-term contracts: If the template does not include the 30-day notice required by CST Article 46, the employer may end up paying an automatic renewal or severance.
- Setting a probation period longer than allowed: Exceeding two months, or one-fifth of the term in short contracts, voids the clause and dismissal during probation could be deemed without cause.
- Not distinguishing social benefits from severance: Severance pay (CST Art. 249), service bonus (CST Art. 306) and vacation pay (CST Art. 186) are separate legal obligations from dismissal indemnity. A template that confuses them leads to incorrect final settlements.
- Including clauses that violate reinforced job stability: Pregnant women, persons with disabilities and union members have special protection. Dismissing them without Ministry of Labor authorization is illegal, regardless of what the template says.

Can I download a template from the internet and use it as-is?
It is not advisable. Generic templates do not account for the specifics of each employment relationship, such as the type of salary, working hours, applicable surcharges under Law 2466 of 2025, or confidentiality and exclusivity clauses. A Colombia employment contract template must be customized for each case, otherwise you risk omissions that will be contested in court.
What happens if the worker does not sign the template?
The employment contract exists as soon as the three essential elements are present (activity, subordination and salary), even without a signed document. However, the lack of written evidence makes it difficult to prove the agreed terms. Does the template need to include the new night shift starting at 7:00 p.m.?
Yes. Law 2466 of 2025 amended Article 160 of the CST to establish that the night shift runs from 7:00 p.m. to 6:00 a.m., with a 35% surcharge on the ordinary hourly rate. Your template must reflect this shift and the corresponding surcharges; otherwise, payroll calculations will be incorrect.
Is it mandatory to have a lawyer review the template?
The law does not require it, but the risks of not doing so are high. A poorly drafted clause on comprehensive salary, probation period or termination causes can invalidate the agreement or lead to significant financial penalties.
